1. Introduction
Welcome to Shipwize Services Ltd and Circles Logistics Ltd ("we," "us," "our," or collectively "the Companies").
These Terms and Conditions ("Terms") govern your access to and use of our services — including the websites shipwize.com and circlesja.com, our mobile applications, customer portals, logistics tracking systems, and any related digital platforms (collectively, the "Services").
The Services are delivered through four connected parts: our public websites; the customer dashboard and mobile applications where you sign in, the web dashboard being at dashboard.circlesja.com; the service that connects them to your account, package, and billing records; and the internal application our staff use at our warehouse and branches. These Terms apply to all of them.
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.
These Terms are governed by the laws of Jamaica, including the Electronic Transactions Act 2006, the Consumer Protection Act 2005, and all other applicable local and international regulations.
2. Scope
These Terms apply to all users of our Services, including:
- Registered account holders and guest users
- Individuals, businesses, and agents using Shipwize or Circles platforms
- Any party accessing our Services through a mobile app, web browser, or third-party integration
These Terms do not apply to third-party websites, services, or applications that we do not control, even if linked from our platforms.
3. Definitions
- Account – a unique profile you create to access our Services.
- Affiliate – an entity that controls, is controlled by, or is under common control with either Company.
- Companies / we / us / our – Shipwize Services Ltd and Circles Logistics Ltd, both headquartered in Kingston, Jamaica.
- Content – any text, images, data, or other materials available through our Services.
- Dashboard – the signed-in customer application at dashboard.circlesja.com, where you manage your Account.
- Notification Service – the optional WhatsApp package updates described in Section 6.
- Order – a confirmed shipment, delivery, or logistics request placed through the Services.
- Services – all digital and physical logistics services provided by the Companies, including shipping, package handling, delivery, and related offerings.
- Suite Number – the mailbox identifier we assign to your Account, which you add to your U.S. shipping address so that arriving packages can be matched to you.
- User / you / your – any individual or entity accessing or using our Services.
4. Eligibility and Account Registration
To access certain features, you must create an Account. By doing so, you confirm that:
- You are at least 16 years of age;
- All registration information you provide is accurate, current, and complete;
- You will keep your account credentials confidential and notify us immediately of any unauthorized use;
- You are legally capable of entering into a binding agreement in your jurisdiction.
Your Account is personal to you. Anyone who signs in with your credentials, or who you name as an authorized collector, is treated as acting with your permission until you tell us otherwise.
Keep the details on your Account accurate in the Dashboard. Two of them have conditions worth knowing. Changing the email address on your Account takes effect only after you enter a code we send to the new address, so an address you cannot receive mail at cannot be set. And the people you list as authorized collectors can be told which of your packages are ready and can collect them on your behalf, so remove anyone who should no longer be able to.
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
5. Our Services
Shipwize and Circles provide logistics and courier services including but not limited to:
- International and domestic package shipping and forwarding
- A U.S. mailbox and suite number for receiving your online purchases
- Customs brokerage and documentation assistance
- Real-time shipment tracking through your online account and our mobile applications
- An online account — the Dashboard — showing your suite number and U.S. shipping address, your packages, invoices and receipts, what you owe, your store credit, reward points and referrals, and where you keep your own details up to date
- Status updates by email, and optional package updates by WhatsApp (Section 6)
- Pickup and last-mile delivery
- Consolidated freight and bulk shipping solutions
Service availability, pricing, and features may vary by location and are subject to change without notice. We will make reasonable efforts to communicate material service changes in advance.
6. WhatsApp Package Notifications
We offer an optional Notification Service that sends package updates to your WhatsApp number. These conditions apply to it. How the personal information involved is handled is described in Section 6 of our Privacy Policy.
- It is optional and additional. You never have to use it, and it replaces nothing. Your online account remains the authoritative record of your packages, and the status emails you already receive are unaffected.
- Consent is a two-step process. Ticking the box on our website, in the mobile application, at our counter, or on the signup form does not switch notifications on. It causes exactly one WhatsApp message asking you to confirm. Notifications begin only after you confirm inside WhatsApp, and not before.
- What is sent. A notification contains the package status, the tracking numbers of the packages concerned, and your suite number. We never send payment or card details, bank information, or identity-document data over WhatsApp.
- How often. Four statuses trigger a message — Received In Miami, Arrived In Jamaica, Ready for Pickup, and Delivered to Client — so roughly one message per package per stage. Packages that reach the same stage at about the same time are combined into a single message.
- Delivery is not guaranteed. Messages are carried by the WhatsApp Business Platform, operated by Meta Platforms — a third party we do not control — and also depend on your number, your device, and your network. We do not guarantee that any notification will be delivered, or delivered at a particular time. A late, missing, or undelivered notification does not extend a deadline, waive a storage or other charge, or create liability for us, and you should not rely on WhatsApp alone to know the state of your packages.
- Standard carrier or data charges may apply. We do not charge for the Notification Service, but the cost of receiving messages on your mobile or data plan is yours.
- It is not a support channel. The messages are one-way. Apart from confirming or stopping notifications, we do not monitor or reply to messages sent to that number. Use the contact details in Section 16 instead.
- Give us a number you control. You are responsible for the number you provide and for keeping it current. A number that belongs to someone else will show that person information about your packages.
- Stopping it. You can withdraw consent at any time — in your account on our website, in the mobile application, at our counter, or by replying STOP in WhatsApp. Withdrawing has no effect on any other part of your service.
- We may change or withdraw it. The Notification Service is a convenience offered alongside the shipping service you pay for, not part of it, and we may change, suspend, or discontinue it.
7. Rate Estimates
The rate estimators we offer — the one on our public website and the one inside your account on the Dashboard — return an estimate of freight only, based on the commodity, declared value, and weight you enter, with weight rounded up to the next whole pound. It does not include duty, GCT, the airline fuel surcharge, insurance, customs clearance, or any other charge, and it is not a quote, an offer, or a binding price.
What you owe is calculated on the actual package once we have received, weighed, and classified it, and that amount is what appears on your invoice.
The estimate inside your account is worked out against your account, but it is still an estimate and not a quote. Rates and discounts change, so the same entries can return a different figure on a different day.
8. Orders, Payments, and Fees
All Orders placed through our Services are subject to the following conditions:

| Customs & Duties | The recipient is responsible for all applicable import duties, taxes, and customs fees unless explicitly included in the quoted service fee. |
| Paying | The Dashboard shows what you owe, your invoices, and your receipts. It does not take payment: no card or bank details are asked for or entered there. |
| Store Credit | Store credit is a balance held on your Account and applied against what you owe us. Every adjustment is recorded with its reason and the member of staff who made it. |
| Reward Points | One reward point is earned when payment for a package is completed. Points may be redeemed for store credit at a rate we set and may change from time to time. |
| Referral Credit | If someone signs up using your referral code, the credit is earned once that customer's first package has arrived in Jamaica — not when they sign up. Credit is applied against what you owe. |
| Refunds | Refunds are subject to our Refund Policy. Contact us within 14 days of an issue for review. |
| Disputed Charges | Contact us at info@shipwize.com before initiating a chargeback. We aim to resolve disputes within 10 business days. |
9. Prohibited Items and Uses
You agree not to use our Services to ship, handle, or facilitate:
- Illegal substances, controlled drugs, or contraband
- Weapons, firearms, ammunition, or explosives
- Counterfeit, pirated, or intellectual property-infringing goods
- Perishable goods without prior written authorization
- Hazardous materials unless certified and pre-approved
- Any goods prohibited by Jamaican law, US regulations, or destination-country laws
We reserve the right to inspect, refuse, return, or dispose of any shipment that violates these restrictions, and to report such shipments to the appropriate authorities.
You are responsible for the accuracy of what you declare to us. Declaring the contents or value of a package incorrectly may result in customs penalties, delays, or seizure, and those consequences are yours.
10. Liability and Limitations
To the maximum extent permitted by applicable law:
- Loss or Damage: Our liability for lost or damaged shipments is limited to the declared value of the goods or the applicable service fee paid, whichever is lower, unless additional insurance was purchased.
- Delays: We are not liable for delays caused by customs authorities, weather, third-party carriers, civil unrest, or other events beyond our reasonable control.
- Notifications: We are not liable for an email or WhatsApp notification that is delayed, undelivered, or sent to a number or address you gave us in error. Notifications are a convenience; your online account is the record to rely on.
- Indirect Damages: We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.
- Service Interruptions: We do not guarantee uninterrupted or error-free access to our digital platforms.
Nothing in these Terms excludes liability for death, personal injury, fraud, or any other liability that cannot be excluded under Jamaican law.
11. Intellectual Property
All content on our Services — including logos, trademarks, software, text, graphics, and design — is owned by or licensed to the Companies and is protected by intellectual property laws.
You may not copy, reproduce, distribute, modify, or create derivative works from any of our content without our prior written consent.
Any feedback, suggestions, or ideas you submit to us may be used by the Companies without obligation or compensation to you.
12. Third-Party Services
Our Services may integrate with or link to third-party platforms, payment processors, or carriers. We are not responsible for the practices, content, or reliability of such third parties.
This includes the WhatsApp Business Platform operated by Meta Platforms, which carries the Notification Service described in Section 6 and which you use subject to Meta's own terms.
It also includes Cloudflare, whose Turnstile check runs on the Dashboard's registration, sign-in, and password-reset pages to stop them being attacked automatically. The check has to pass before we will act on any of those three requests, so a browser that blocks it cannot complete them.
Use of third-party services is subject to their own terms and privacy policies. We encourage you to review these before engaging with them.
13. Termination and Suspension
We may suspend or terminate your access to the Services at any time and without prior notice if:
- You breach any provision of these Terms;
- We reasonably suspect fraudulent, unlawful, or abusive behavior;
- We are required to do so by law or regulatory order.
You may close your account at any time by contacting us (see Section 16); there is no button in the Dashboard that does it. Upon termination, outstanding obligations — including payment of fees or outstanding shipments — remain enforceable.
14. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of Jamaica.
Any dispute arising from or relating to these Terms or our Services shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Kingston, Jamaica, in accordance with the Arbitration Act (Jamaica).
Nothing in this section prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.
15. Indemnification
You agree to indemnify, defend, and hold harmless the Companies, their Affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising from:
- Your use of the Services;
- Your violation of these Terms;
- Any shipment you arrange that causes harm or violates applicable law;
- Your infringement of any third-party rights.

17. Changes to These Terms
We may revise these Terms periodically to reflect operational, legal, or regulatory updates.
The latest version will always appear on our websites.
If we make material changes, we will notify users by email or in-app notice before the new terms take effect. Continued use of our Services after such notice constitutes acceptance of the revised Terms.
